SMA Minor Construction

New BMPs as designed in the SMA Minor permit were put in place before any sitework commenced. The grading permit was closed on July 18, 2022. The electrical permit was closed on June 21, 2023 and the overall permit closed on June 30, 2023 after a final inspection by DPP and HECO. Signs were posted facing both inside and outside the property directing pedestrians to use the crosswalk at Pupukea Road. The Pahoe Road fence was completed on August 19th, 2021.

Tenant Compliance

All trucks completed their required two moves in February. Single-use plastics, plastic straws, and non-reef-safe sunscreen continue to be prohibited for all tenants. Tour buses continue to be prohibited from the site. All tenants have been notified to remind customers to use the crosswalk at Pupukea Road when crossing Kamehameha Highway. Any signs within 30 feet of the highway have been removed.

Baseline Inspection Report and Compliance

Inspectors from DPP visited the property unannounced in February 2021 and conducted a baseline inspection of the entire property. Hanapohaku and others received the report on February 23rd, 2021. Hanapohaku has since reviewed the report including the photos and required changes described in it. All tents required to be removed were immediately taken down. The signs included in the report have all been removed. The electrical violations have been addressed.

The North Shore Surf Shop and Seamaids had a "Big Sale" this weekend with two large banner signs and displays of Surfboards propped up along the planters and snorkels and other gear displayed outside that violate the Settlement Agreement. I will email you the photos. *This is a repeat violation.* See Complaint in January 2024 and your reply below. I donʻt understand why these blatant violations continue. What did you communicate about this issue to your client after the prior incident and when did you communicate it? Please provide that information and ensure compliance with the "no hawking" and outdoor display.signage terms of the Settlement Agreement. See complaint on hotline. Here are the photos. Super frustrating for SSCA and the community to see this blatant violation of the Settlement Agreement. Numerous people were complaining about the "Circus" on your site. This isnʻt Waikiki.  Stop it.

Where is the breakdown in communication with you and your client/tenants?

Hi Denise - We reached out to the tenant and had them take down the sign and surfboards. We have also confirmed with them that neither of these will not go back up.

Gents, Once again you are in flagrant disregard of the MSA with the two giant RED "Big Sale" signs posted last night the snorkel and surfboard shops. What's with you guys! You talk about community, then completely disrespect it by doing stuff like this. If that is not Tourist hawking, then I don't know what is.

Thank you for your response and ensuring that the "hawking" -- two big "For Sale" signs and numerous surfboards propped up along the planters -- were removed.For the record, can you tell us the date and time the items were taken down? I understand that John Thielst also submitted a complaint so I am copying him here. I do not understand why this violation reoccured. This "Big Sale" and display of the boards should have never happened in the first place. After the last incident, did you clearly communicate to your tenants that this violates the Settlement Agreement? In addition, not all of the "gear" was removed - the snorkel "line," mannequins, dresses, beach gear, and numerous surfboards and other items are STILL on visible display facing the Highway.  These need to be removed. Please ensure this is taken care of asap and that the tenants understand that these are violations of the Settlement Agreement.

Hi Denise - The issue of the sign and surfboards has been addressed with the tenant, taken down, and Hanapohaku remains in compliance with the settlement agreement. We have already responded to John separately but included him on this email as well. Just a heads up that due to travel any additional messages received in February will be included in the March report.
